Digital Assets may be created by Marketeq, provided by clients, or licensed from third parties. Each Digital Asset is subject to the rights and license terms applicable to it. This definition guides how we identify and manage Digital Assets. The treatment of a particular Digital Asset depends on its ownership and the applicable rights.

3. Ownership and Rights

Digital Assets owned by Marketeq are its exclusive property and are protected by applicable intellectual property laws. Digital Assets provided by clients or licensed from third parties remain the property of their respective owners and are used by Marketeq only in accordance with the applicable rights or license terms. We take reasonable steps to identify the ownership and rights associated with the Digital Assets we manage. We do not use Digital Assets in a manner that exceeds the scope of the applicable rights. Respecting the ownership of Digital Assets is central to this Policy.

4. Acquisition and Licensing

When Marketeq acquires or licenses Digital Assets from third parties, we take reasonable steps to ensure that we obtain the rights necessary for our intended use. We review applicable license terms to understand any restrictions, attribution requirements, or usage limits. We seek to obtain licenses that are appropriate for the intended purpose, including for client deliverables where relevant. We retain records of significant licenses to support compliance. Responsible acquisition and licensing help us to use Digital Assets lawfully.

5. Storage and Organization

Marketeq stores and organizes its Digital Assets using appropriate systems and practices designed to protect their integrity and to facilitate their appropriate use. We apply access controls so that Digital Assets are accessible only to those with a legitimate need. We seek to maintain accurate information about the source, ownership, and license terms of the Digital Assets we manage. Proper storage and organization reduce the risk of unauthorized or improper use. We treat the security of Digital Assets consistently with our broader data security practices.

6. Permitted Use

Digital Assets managed by Marketeq must be used only in accordance with the rights and license terms applicable to them and only for legitimate business purposes. Personnel and authorized users must not use Digital Assets in a manner that exceeds the scope of the applicable rights or that infringes upon the rights of any owner. Where a Digital Asset is subject to attribution or other conditions, those conditions must be observed. Any use of Digital Assets outside the scope permitted requires appropriate authorization. We expect all users of our Digital Assets to respect the applicable rights.

7. Protection Against Misuse

Marketeq takes reasonable measures to protect its Digital Assets against unauthorized access, copying, alteration, or distribution. We monitor the use of Digital Assets where appropriate and take action to address any misuse. Unauthorized use of Marketeq's Digital Assets may infringe upon our intellectual property rights and may result in appropriate action. We also take steps to ensure that third-party and client Digital Assets are protected in accordance with the applicable rights. Protecting Digital Assets against misuse is an important element of this Policy.

8. Retention and Disposal

Marketeq retains Digital Assets only for as long as necessary for legitimate business purposes or as required by applicable license terms or law. When a Digital Asset is no longer required, or when the applicable license expires, we take appropriate steps to cease using it and, where required, to delete or remove it. We handle the disposal of Digital Assets in a manner consistent with our Data Retention Policy. Proper retention and disposal help to ensure that Digital Assets are not used beyond the scope of the applicable rights. We address the expiry of licenses in a timely manner.
