Welcome to Marketeq Digital Inc. (hereinafter referred to as "Marketeq," "we," "us," or "our"). This Payment and Refund Policy (the "Policy") governs the fees, billing, and refund terms applicable to the paid services, digital products, and subscriptions offered by Marketeq (collectively, the "Paid Services"). This Policy forms part of our agreement with you and should be read together with our Terms of Use and any applicable order form or service agreement. By purchasing or subscribing to any Paid Service, you acknowledge that you have read, understood, and agreed to be bound by this Policy. If you do not agree with this Policy, you must not purchase or subscribe to any Paid Service.
For the purposes of this Policy, "Fees" means the charges payable for access to or use of the Paid Services. "Billing Cycle" means the recurring period, such as monthly, quarterly, or annual, for which Fees are charged. "Subscription" means a recurring arrangement under which you obtain ongoing access to a Paid Service. "Refund" means the return of Fees previously paid, subject to the conditions set forth in this Policy. These definitions apply throughout this Policy regardless of whether they appear in the singular or the plural.
The Fees applicable to each Paid Service will be presented to you at the time of purchase or as set out in the applicable order form or service agreement. All Fees are quoted and payable in the currency specified at the time of purchase and are exclusive of any applicable taxes, duties, or levies, which shall be your responsibility unless otherwise stated. Marketeq reserves the right to modify its pricing at any time, provided that any change to the Fees for an existing Subscription will take effect only upon the commencement of the next Billing Cycle following reasonable notice. You are responsible for reviewing the applicable Fees before completing any purchase. Where volume, enterprise, or custom pricing has been agreed in writing, the terms of that agreement shall govern.
You agree to provide accurate, current, and complete payment information and to promptly update such information as necessary. By providing a payment method, you authorize Marketeq or its designated payment processor to charge the applicable Fees to that payment method in accordance with the selected Billing Cycle. If a payment is declined, not received, or otherwise fails, Marketeq may suspend or restrict your access to the Paid Services until the outstanding amount is paid. You are responsible for all Fees incurred under your account, including any applicable taxes. Marketeq is not responsible for any charges imposed by your financial institution or payment provider.
Unless otherwise stated, Subscriptions renew automatically at the end of each Billing Cycle at the then-current Fees until cancelled in accordance with this Policy. By subscribing to a Paid Service, you authorize Marketeq to charge the applicable Fees at the beginning of each renewal term using your designated payment method. You may disable automatic renewal at any time by cancelling your Subscription prior to the renewal date, in which case you will retain access to the Paid Service until the end of the current Billing Cycle. It is your responsibility to cancel before the renewal date if you do not wish to be charged for the next Billing Cycle. We will endeavor to provide notice of upcoming renewals where required by applicable law.
Except as expressly set forth in this Policy or as required by applicable law, Fees paid for the Paid Services are non-refundable. Where a refund is available, it must be requested within the applicable refund window communicated at the time of purchase, and it will be limited to the unused portion of the Fees for the current Billing Cycle. Refunds are not provided for prior Billing Cycles, for periods during which the Paid Service was available for use, or for metered or usage-based charges already incurred. If Marketeq terminates your access for cause, such as a violation of our Terms of Use, you will remain responsible for any outstanding Fees and will not be entitled to a refund. Marketeq reserves the right to evaluate each refund request on a case-by-case basis and to grant or deny refunds at its sole discretion, consistent with applicable law.
Approved refunds will be issued to the original payment method used for the purchase, unless otherwise agreed. Refunds are typically processed within a reasonable period following approval, though the time required for the funds to appear may vary depending on your payment provider. Marketeq is not responsible for delays attributable to your financial institution or payment processor. If you believe you are entitled to a refund that you have not received, please contact us at legal@marketeqdigital.com.
You may cancel a Subscription at any time through the account management options made available to you or by contacting us at legal@marketeqdigital.com. Cancellation will take effect at the end of the current Billing Cycle, and you will continue to have access to the Paid Service until that time unless otherwise required by law. Cancellation stops future renewals and associated charges but does not, by itself, entitle you to a refund of Fees already paid. Please refer to our Subscription and Cancellation Policy for additional details regarding the cancellation process.
If you believe that you have been charged in error, you must notify Marketeq promptly and in any event within a reasonable period after the charge appears. We will investigate any disputed charge in good faith and will issue a correction or refund where we determine that an error has occurred. Initiating a chargeback or payment dispute without first contacting Marketeq may result in the suspension of your account pending resolution. We are committed to resolving billing disputes fairly and efficiently.
Marketeq reserves the right to modify or update this Payment and Refund Policy at any time and at its sole discretion. Any changes will become effective upon posting the revised Policy, and your continued use of the Paid Services following such posting constitutes acceptance of the changes. Where changes are material, we will endeavor to provide reasonable advance notice. It is your responsibility to review this Policy periodically.
