4. Restrictions

Except as expressly permitted, you may not copy, modify, distribute, sell, sublicense, or create derivative works from the Proprietary Tools. You may not reverse engineer, decompile, or disassemble the Proprietary Tools, or attempt to derive their source code, except to the extent such restrictions are prohibited by applicable law. You may not remove or alter any proprietary notices contained in the Proprietary Tools, nor use them to develop competing products or services. You may not disclose the Proprietary Tools or any related confidential information to any unauthorized third party. These restrictions are essential to protecting Marketeq's proprietary assets.

5. Confidentiality

The Proprietary Tools and any related information constitute confidential and proprietary information of Marketeq. You agree to keep such information confidential, to use it only for authorized purposes, and not to disclose it to any unauthorized party. Your confidentiality obligations continue for as long as the information remains confidential and are in addition to any separate confidentiality agreement between you and Marketeq. The unauthorized disclosure of the Proprietary Tools may cause significant harm to Marketeq. We treat the confidentiality of our Proprietary Tools as a priority.

6. Updates and Changes

Marketeq may update, modify, or enhance the Proprietary Tools at any time and is under no obligation to maintain any particular version or feature. Where updates are provided in connection with a service, they are subject to this Policy and any applicable agreement. Marketeq does not guarantee that the Proprietary Tools will remain compatible with any particular system or environment. We reserve the right to discontinue any Proprietary Tool at our discretion. Continued use of any Proprietary Tool following an update constitutes acceptance of the change.

7. No Warranty

Except as expressly provided in an applicable agreement, the Proprietary Tools are provided on an "as is" basis without warranties of any kind, whether express or implied. Marketeq does not warrant that the Proprietary Tools will be error-free, uninterrupted, or fit for any particular purpose beyond that expressly agreed. To the maximum extent permitted by applicable law, Marketeq disclaims all implied warranties in relation to the Proprietary Tools. Any warranties applicable to a specific engagement are set out in the relevant agreement. You assume responsibility for your use of the Proprietary Tools within the scope permitted.

8. Enforcement

Marketeq reserves the right to take appropriate action to protect the Proprietary Tools against unauthorized use, disclosure, or infringement. This may include requiring the cessation of unauthorized use, revoking any license, and pursuing available legal and equitable remedies, including injunctive relief. Marketeq's failure to enforce a particular provision does not waive its right to enforce that or any other provision in the future. We treat the protection of our Proprietary Tools as essential to our business.

9. Changes to This Policy

Marketeq reserves the right to modify or update this Proprietary Software and Tools Policy at any time to reflect changes in our practices or legal requirements.
