Welcome to Marketeq Digital Inc. (hereinafter referred to as "Marketeq," "we," "us," or "our"). This Subscription and Cancellation Policy (the "Policy") explains the terms that apply when you subscribe to, renew, or cancel any subscription-based service or digital product offered by Marketeq (collectively, the "Subscription Services"). This Policy forms part of our agreement with you and should be read together with our Payment and Refund Policy and Terms of Use. By subscribing to any Subscription Service, you acknowledge that you have read, understood, and agreed to be bound by this Policy. If you do not agree with this Policy, you should not subscribe to any Subscription Service.

1. Definitions

For the purposes of this Policy, "Subscription" means a recurring arrangement providing ongoing access to a Subscription Service. "Subscription Term" means the period for which a Subscription is active, whether monthly, quarterly, annual, or otherwise. "Renewal" means the automatic continuation of a Subscription for a further Subscription Term. "Cancellation" means the termination of a Subscription by you or by Marketeq. These definitions apply throughout this Policy regardless of whether they appear in the singular or the plural.

2. Subscription Enrollment

When you enroll in a Subscription, you select a plan and a Subscription Term, and you agree to pay the applicable fees for that plan in accordance with our Payment and Refund Policy. Your Subscription grants you access to the features and functionality associated with your selected plan for the duration of the Subscription Term. The specific features, usage limits, and service levels applicable to your Subscription will be presented to you at the time of enrollment or as set out in the applicable order form. You are responsible for selecting a plan that meets your needs and for reviewing the terms associated with that plan before enrolling.

3. Automatic Renewal

Unless otherwise specified, Subscriptions renew automatically at the end of each Subscription Term for a successive term of equal length, at the then-current fees, until cancelled. By enrolling in a Subscription, you authorize Marketeq to charge your designated payment method for each Renewal. We will endeavor to provide notice of upcoming Renewals where required by applicable law. If you do not wish for your Subscription to renew, you must cancel it before the end of the current Subscription Term. Continued access to the Subscription Service following a Renewal constitutes acceptance of the applicable renewal terms and fees.

4. How to Cancel

You may cancel your Subscription at any time through the account management options made available within the Subscription Services or by contacting us at legal@marketeqdigital.com. To avoid being charged for the next Subscription Term, you must complete your cancellation before the renewal date. Once cancelled, your Subscription will not renew, and you will retain access to the Subscription Service until the end of the current Subscription Term, unless otherwise required by law. We recommend that you retain confirmation of your cancellation for your records.

5. Effect of Cancellation

Upon the effective date of cancellation, your right to access and use the applicable Subscription Service will cease, and any data associated with your Subscription may be handled in accordance with our Data Retention Policy and applicable law. Cancellation stops future Renewals and associated charges but does not entitle you to a refund of fees already paid, except as provided in our Payment and Refund Policy or as required by law. Where reasonably practicable, you may be given a limited period following cancellation to export data associated with your Subscription before it is deleted. Certain obligations incurred prior to cancellation, including outstanding fees, shall survive the cancellation of your Subscription.

6. Changes to Subscriptions

You may upgrade or downgrade your Subscription plan where such options are made available. Upgrades typically take effect immediately, and any additional fees may be prorated for the remainder of the current Subscription Term. Downgrades typically take effect at the start of the next Subscription Term, and any reduction in features or usage limits will apply from that time. Marketeq reserves the right to modify the features, usage limits, or fees associated with a Subscription plan, provided that any material change affecting an existing Subscription will take effect upon the commencement of the next Subscription Term following reasonable notice.

7. Suspension and Termination by Marketeq

Marketeq reserves the right to suspend or terminate your Subscription at any time, with or without cause, including where you fail to pay applicable fees or violate our Terms of Use or other policies. Where a Subscription is terminated for cause, you will remain responsible for any outstanding fees, and no refund will be provided. Marketeq will endeavor to provide reasonable notice of any suspension or termination, except where immediate action is necessary to protect the security or integrity of the Subscription Services or the rights of others. The provisions of this Policy that by their nature should survive termination shall continue to apply.

8. Free Trials and Promotional Offers

From time to time, Marketeq may offer free trials or promotional Subscriptions subject to additional terms communicated at the time of the offer. Unless you cancel before the end of a free trial period, your Subscription may automatically convert to a paid Subscription, and your designated payment method may be charged the applicable fees. Promotional pricing applies only for the period specified, after which standard fees will apply. Marketeq reserves the right to modify or discontinue any free trial or promotional offer at any time.

9. Changes to This Policy

Marketeq reserves the right to modify or update this Subscription and Cancellation Policy at any time and at its sole discretion. Any changes will become effective upon posting the revised Policy, and your continued use of the Subscription Services following such posting constitutes acceptance of the changes. It is your responsibility to review this Policy periodically to remain informed of any updates.
