We respect any usage limits, seat counts, or field-of-use restrictions that apply to licensed software. Where third-party software is used in connection with a client engagement, the applicable license terms may impose obligations on the client as well as on Marketeq. We endeavor to identify significant third-party software incorporated into or required for the use of deliverables and to inform clients of relevant licensing considerations. In some cases, a client may need to obtain its own license for certain third-party software. Marketeq does not grant clients any rights in third-party software beyond those permitted by the applicable license. The treatment of third-party software in a particular engagement is subject to the terms of the applicable client agreement.
Marketeq does not use, and does not permit the use of, third-party software in a manner that violates the applicable license or infringes upon the rights of the licensor. We do not use unlicensed or pirated software, and we do not circumvent technical protection measures except where expressly permitted. We do not exceed the scope of use authorized by a license or use software in prohibited fields of use. Any use of third-party software that would breach the applicable license is prohibited. We treat license compliance as a matter of both legal obligation and professional integrity.
Marketeq takes reasonable steps to manage its use of third-party software, including maintaining awareness of the licenses applicable to the software it uses. We seek to ensure that our use of licensed software remains within the scope of the applicable license and that renewals or additional licenses are obtained where necessary. Marketeq does not provide any warranty in respect of third-party software beyond what is expressly agreed and passes through applicable third-party warranties only to the extent permitted by the relevant license. We are not responsible for defects, vulnerabilities, or discontinuation of third-party software by its vendor. Where third-party software is used in a deliverable, the client's recourse in respect of that software may be limited to the terms offered by the third-party licensor. We disclaim liability for third-party software to the extent permitted by applicable law.
Marketeq reserves the right to modify or update this Third-party Software Licensing and Usage document at any time to reflect changes in our practices or legal requirements. Any changes will become effective upon posting the revised Policy, and we encourage you to review it periodically. Continued use of our Services following any changes constitutes acceptance of the revised Policy.
