Welcome to Marketeq Digital Inc. (hereinafter referred to as "Marketeq," "we," "us," or "our"). These User Content and Conduct Guidelines (the "Guidelines") govern the content you submit, post, upload, or transmit through our website, client portals, digital products, and related services (collectively, the "Services"), as well as your conduct while using them. These Guidelines are intended to foster a respectful, secure, and professional environment for all users. By submitting content or otherwise interacting with the Services, you agree to comply with these Guidelines and all policies referenced herein. If you do not agree with these Guidelines, you must refrain from submitting content or participating in the Services.
For the purposes of these Guidelines, "User Content" means any content, including text, images, comments, feedback, documents, code, or other materials, that you submit, post, upload, or transmit through the Services. "Submission" refers to the act of making User Content available through the Services. "Conduct" refers to your behavior and interactions while using the Services. These definitions apply regardless of whether the terms appear in the singular or the plural. The intent of these definitions is to ensure clarity and consistency throughout these Guidelines.
You retain ownership of any intellectual property rights that you hold in the User Content you submit. By submitting User Content, you grant Marketeq a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, host, store, reproduce, modify, adapt, publish, and display such User Content solely for the purpose of operating, providing, and improving the Services. This license continues even if you stop using the Services, to the extent necessary for legitimate business, legal, or operational purposes. You represent and warrant that you own or have the necessary rights to the User Content you submit and that its use by Marketeq will not infringe upon the rights of any third party. Marketeq does not claim ownership of your User Content beyond the rights granted under this license.
All User Content must comply with applicable laws and must not infringe upon the rights of any third party. You agree that you will not submit User Content that is unlawful, defamatory, obscene, harassing, threatening, discriminatory, or otherwise objectionable. You must not submit content that contains malicious code, that violates the intellectual property or privacy rights of others, or that misrepresents your identity or affiliation. Content that is confidential or proprietary to a third party must not be submitted unless you have obtained the necessary consent. Marketeq reserves the right, but assumes no obligation, to review, screen, or remove any User Content that it determines, in its sole discretion, to be in violation of these Guidelines.
When using the Services, you agree to conduct yourself in a manner that is respectful, lawful, and professional. You must not harass, abuse, threaten, or intimidate other users, and you must refrain from using abusive, obscene, or offensive language. Because the Services may be accessed by a diverse and multicultural audience, you should exercise courtesy and sensitivity in your interactions, recognizing that content which may seem acceptable to you could be perceived otherwise by others. You must not engage in any activity that disrupts, interferes with, or degrades the experience of other users. Any attempt to manipulate, deceive, or exploit other users or the Services is strictly prohibited.
You are prohibited from using the Services to distribute unsolicited commercial communications, engage in fraudulent or deceptive practices, or impersonate any person or entity. You must not attempt to collect or harvest personal information about other users without their consent. You may not use automated means to submit content or interact with the Services in a manner that imposes an unreasonable burden on our infrastructure. Any circumvention or attempted circumvention of security measures, content filters, or access controls is forbidden. Marketeq considers such activities to be serious violations that may result in immediate suspension or termination of access.
Marketeq reserves the right, but does not assume the obligation, to monitor User Content and conduct on the Services in order to ensure compliance with these Guidelines and to protect the security and integrity of the Services. We may, at our sole discretion and without prior notice, remove or disable access to any User Content, or restrict, suspend, or terminate the account of any user who violates these Guidelines. We may also cooperate with law enforcement authorities and disclose information as necessary to investigate suspected unlawful conduct. Marketeq is not responsible for any User Content submitted by users, and such content does not necessarily reflect the opinions or positions of Marketeq. Our decision to take or refrain from taking action with respect to any User Content shall not waive our right to act with respect to the same or similar content in the future.
We encourage you to report any User Content or conduct that you believe violates these Guidelines, including harassment, intellectual property infringement, or other inappropriate behavior. Reports may be submitted to us at legal@marketeqdigital.com, and we will review each report and take appropriate action in accordance with these Guidelines and applicable law. While we strive to respond to all reports in a timely manner, we do not guarantee that any specific action will be taken. Your cooperation helps us maintain a safe and trustworthy environment for all users.
To the fullest extent permitted by applicable law, Marketeq disclaims all liability arising from User Content submitted by users and from any reliance placed on such content. The Services are provided on an "as is" and "as available" basis, and Marketeq does not warrant that the Services will be free of objectionable content. Marketeq shall not be liable for any indirect, incidental, special, or consequential damages arising from your submission of User Content or your conduct on the Services. You agree to indemnify and hold Marketeq harmless from any claims arising out of the User Content you submit or your violation of these Guidelines.
Marketeq reserves the right to modify or update these User Content and Conduct Guidelines at any time and at its sole discretion. Any changes will become effective upon posting the revised Guidelines to the Services, and your continued use of the Services following such posting constitutes acceptance of the changes. We recommend that you review these Guidelines periodically to remain informed of any updates.
