Welcome to Marketeq Digital Inc. (hereinafter referred to as "Marketeq," "we," "us," or "our"). These Website Testing and Beta Features Terms (the "Terms") govern your access to and use of any pre-release, trial, evaluation, pilot, or beta features, products, or services made available by Marketeq (collectively, the "Beta Features"). Beta Features are provided to allow testing, evaluation, and feedback prior to general release and are distinct from our generally available services. By accessing or using any Beta Feature, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree with these Terms, you must not access or use any Beta Feature.

1. Nature of Beta Features

Beta Features are experimental in nature and are made available for testing and evaluation purposes only. You acknowledge that Beta Features may be incomplete, may contain bugs, errors, or defects, and may not function as intended or as described. Beta Features may be changed, suspended, or discontinued at any time without notice, and they may never be released for general availability. The performance, reliability, and availability of Beta Features may differ significantly from those of our generally available services. You should not rely on Beta Features for any business-critical, production, or time-sensitive purpose.

2. License and Permitted Use

Subject to your compliance with these Terms, Marketeq grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Beta Features solely for the purpose of internal testing, evaluation, and providing feedback. You may not use the Beta Features for any commercial or production purpose unless expressly authorized in writing by Marketeq. You must use the Beta Features in accordance with any additional instructions or documentation we provide. Any use of the Beta Features beyond the scope permitted by these Terms is strictly prohibited.

3. Feedback

We value the feedback you provide in connection with the Beta Features, and we encourage you to report any issues, defects, or suggestions to us. By providing feedback, you grant Marketeq a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, and incorporate that feedback into our products and services without any obligation to compensate you. Feedback you provide is not confidential to you, and Marketeq may use it for any purpose. You represent that any feedback you provide does not infringe upon the rights of any third party and that you are entitled to provide it.

4. Confidentiality

The Beta Features, together with any related documentation and performance information, may constitute confidential information of Marketeq. You agree to keep such confidential information secure and not to disclose it to any third party without our prior written consent. Unless we announce otherwise, you must not publicly discuss, benchmark, or publish information about the Beta Features, including their existence, features, or performance. Your confidentiality obligations shall continue until the relevant information becomes publicly available through no fault of your own. These obligations are in addition to any separate confidentiality agreement between you and Marketeq.

5. Data and Content

You acknowledge that data and content processed through Beta Features may be subject to loss, corruption, or unavailability, and you are responsible for maintaining backup copies of any important data. Marketeq shall not be liable for any loss of or damage to data arising from your use of the Beta Features. You must not use Beta Features to process sensitive, regulated, or business-critical data unless expressly permitted in writing. Any data you submit through the Beta Features will be handled in accordance with our Privacy Policy and applicable law.

6. Disclaimer of Warranties

The Beta Features are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by applicable law, Marketeq expressly disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, with respect to the Beta Features. Marketeq does not warrant that the Beta Features will be uninterrupted, secure, error-free, or that any defects will be corrected. You assume all risk arising from your access to and use of the Beta Features.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Marketeq be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising from your use of or inability to use the Beta Features, even if advised of the possibility of such damages. Because Beta Features are provided without charge and for evaluation purposes, Marketeq's total liability arising from or relating to the Beta Features shall not exceed the greater of the amount you paid, if any, to access the Beta Features or a nominal sum. This limitation applies regardless of the theory of liability. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

8. Termination

Marketeq may suspend or terminate your access to any Beta Feature at any time, with or without cause, and with or without notice. Upon termination or upon the conclusion of the testing period, your license to use the Beta Feature will immediately cease, and you must stop all use and delete any related materials in your possession. The provisions of these Terms that by their nature should survive termination, including confidentiality, feedback, and limitation of liability, shall continue to apply. Marketeq is under no obligation to provide, maintain, or transition any Beta Feature to general availability.

9. Changes to These Terms

Marketeq reserves the right to modify or update these Website Testing and Beta Features Terms at any time and at its sole discretion. Any changes will become effective upon posting the revised Terms, and your continued use of any Beta Feature following such posting constitutes acceptance of the changes. It is your responsibility to review these Terms periodically.
